Welcome to Nova Capital Finance (“we,” “us,” or “our”). By accessing or using our services, you agree to be bound by these Terms of Service (“Terms”). Please read them carefully.

1. Services Provided

1.1 Business Funding Assistance

• We specialize in assisting clients to secure funding for their businesses.
• Clients may qualify for up to $250,000 in funding for each of their businesses.

1.2 Credit Repair Referrals

• If a client requires credit repair to qualify for funding, we may refer them to trusted third-party vendors.
• Any agreements or fees for credit repair services are between the client and the third-party vendor and are not associated with Nova Capital Finance.

2. Performance-Based Fees

2.1 No Upfront Costs

• Our business funding service is 100% performance-based.
• Clients are not required to pay any fees unless we successfully secure funding for their business.

2.2 Success Fee

• Once funding is secured, we will invoice the client a fee equal to 8% of the total funding amount secured per each business.
• The invoice will be issued upon confirmation of the secured funding.

2.3 Payment Terms

• Payment of the success fee is due upon receipt of the invoice.
• Accepted payment methods will be outlined in the invoice.

3. No Refund Policy

3.1 Non-Refundable Fees

• Due to the performance-based nature of our services, all fees are non-refundable once funding has been secured.
• By agreeing to these Terms, you acknowledge and accept this no-refund policy.

4. Cancellation Policy

4.1 Cancellation Before Funding

• Clients may cancel our services at any time before funding is secured without any penalties or obligations.

4.2 Cancellation After Funding

• Once funding has been secured, the client is obligated to pay the success fee as outlined in Section 2.
• Cancellations are not accepted after funding has been secured.

5. Client Responsibilities

5.1 Accurate Information

• Clients must provide accurate and complete information necessary for the funding process.
• Any misrepresentation or omission may result in delays or inability to secure funding.

5.2 Cooperation

• Clients agree to cooperate fully by providing required documentation and responding promptly to requests.

6. Credit Repair Services

6.1 Third-Party Vendors

• Credit repair services are provided by independent third-party vendors.
• Nova Capital Finance is not responsible for the services rendered by these vendors.

6.2 Fees and Agreements

• Any fees or contractual agreements for credit repair are solely between the client and the third-party vendor.
• We do not receive any compensation or fees from these vendors.

7. Soft Credit Pulls

7.1 Consent and Fee

• With your explicit consent, we may perform a soft credit pull to obtain your credit report.
• A $45 fee applies to the soft credit pull, which will be refunded if you qualify for our program.

7.2 Impact on Credit Score

• Soft credit pulls do not affect your credit score.
• Alternatively, clients may provide credit reports from the three major credit bureaus.

8. Confidentiality and Privacy

8.1 Data Protection

• We are committed to protecting your personal and sensitive information.
• Please refer to our Privacy Policy for details on how we collect, use, and safeguard your data.

8.2 Information Sharing

• We do not sell or rent your personal information to third parties.
• Information may be shared with third parties only as necessary to provide our services and as outlined in our Privacy Policy.

9. Limitation of Liability

9.1 No Guarantee of Funding

• While we strive to secure funding for all clients, we do not guarantee that funding will be obtained.

9.2 Indirect Damages

• Nova Capital Finance shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services.

10. Governing Law

• These Terms are governed by and construed in accordance with the laws of [Insert Jurisdiction], without regard to its conflict of law provisions.

11. Amendments

• We reserve the right to modify these Terms at any time.
• Any changes will be effective immediately upon posting on our website.
• Continued use of our services constitutes acceptance of the revised Terms.
